• 2016년 6월 15일, 미국 특허상표청(USPTO)은 「로스쿨 특허·상표 실습 프로그램(Law School Clinic Certification Program)」을 확대한다고 발표함
 - (배경) 2008년, USPTO는 6개 로스쿨을 지정하여 로스쿨 학생들이 담당 교수의 지도를 받아 특허 또는 상표의 출원 절차, 소송 등의 실무를 직접 경험해 볼 수 있는 기회를 제공하는 실무 교육 프로그램인 「로스쿨 특허·상표 실습 시범 프로그램」을 도입함
  ∙ USPTO는 2010년, 2012년, 2014년에 걸쳐 동 프로그램을 확대함
  ∙ 2014년 12월 16일, 동 프로그램에 대한 법적 근거가 마련됨¹⁾
 - (목적) 동 프로그램은 일반 대중의 특허 출원 등을 위한 무료 법률 상담을 지원하고 미국의 아이디어 보호 및 혁신을 지원할 차세대 변호사의 양성을 목적으로 함
 - (주요내용) 현재 동 프로그램에는 특허와 상표(17개), 특허(6개), 상표(19개) 부분에서 총 42개의 로스쿨이 참여하고 있음
  ∙ 동 프로그램에 신규로 참여하고자 하는 로스쿨은 2017년 6월 30일까지 USPTO에 신청서를 제출하여야 하며, USPTO는 심사를 통해 추가적인 참여 로스쿨을 선정할 예정임

1) 혁신 증진 및 발명가, 중소기업, 벤처기업에 대한 무료 법률상담 확대를 위하여 동 시범 프로그램의 시행 확대를 내용으로 하는 법안(H.R. 5108)이 의회를 통과하여 2014년 12월 16일에 법률(Public Law 113-227)로서 확정됨. 동법은 기존 USPTO의 「로스쿨 특허·상표 실습 시범 프로그램」에서 “시범(pilot)”을 제거하고, 향후 10년 간 미국 전역에서 동 프로그램을 시행하도록 규정하고 있음. 또한, USPTO 청장에게 동 프로그램에 대한 신청과 참여를 위한 규칙 및 절차를 제정하도록 함.
