• 2016년 12월 15일, 국제의약품구매기구(UNITAID)¹⁾ 집행이사회(Executive Board)는 TRIPS 유연성 조항(TRIPS flexibility)의 사용에 관한 결의안을 채택함
  - (배경) 2016년 12월 6일, UNAIDS²⁾ 프로그램 조정위원회(Programme Coordinating Board)는 제39회 회의에서 발표된 의약품 접근을 위한 UN 고위 패널³⁾ 보고서를 통해 의약품 접근성과 지식재산 장벽에 관한 문제를 논의함
   ∙ 더불어 UN 산하 기관들의 역할을 강조하고 더욱 심화된 논의를 개진할 것을 촉구함
  - (주요내용) UNITAID 집행이사회는 결의안 제5호 ‘지식재산 관련 개입 영역: TRIPS 유연성 조항의 사용 지원(Area for Intervention related to Intellectual Property: Supporting the use of TRIPS flexibilities)’⁴⁾을 채택하였으며, 그 내용은 다음과 같음
   ∙ UNITAID 헌장 제1장 제2조⁵⁾에 설시된 바와 같이, 의약품 접근성과 관련하여 지식재산 장벽이 경쟁 및 가격 절하를 방해할 경우에 ‘TRIPS 협정 및 공중보건에 관한 도하 선언’⁶⁾의 틀 안에서 강제실시 또는 기타 유연성 조항의 사용을 지원함
   ∙ 저렴하게 제조된 의약품에 대한 공평한 접근을 도모·증진시키기 위하여, UNITAID는 TRIPS 유연성 조항의 채택·보호·사용에 관한 모범사례를 공유·홍보하는 것에 대한 장려 조치를 지원할 필요가 있음
   ∙ 따라서 UNITAID 사무국(secretariat)은 지식재산과 관련하여 개입이 필요한 영역 내에서 제기될 수 있는 제안을 고려·요청해야 하며 UNITAID 정책전략위원회(Policy and Strategy Committee)에 그 이행 상황을 보고해야함

5) 1.2. To fulfill its mission, UNITAID will use sustainable, predictable and additional funding to help generate a steady demand for drugs and diagnostics, thereby significantly impacting market dynamics to reduce prices and increase availability and supply. UNITAID will base its price reduction strategy on market competition. Where intellectual property barriers hamper competition and price reductions, it will support the use by countries of compulsory licensing or other flexibilities under the framework of the Doha declaration on the Trade-Related Aspects on Intellectual Property Rights (TRIPS) Agreement and Public Health, when applicable.
