• 2022년 9월 22일, 영국 지식재산청(UKIPO)은 ‘인공지능(AI) 발명 관련 특허 출원 심사 가이드라인(Examining patent applications relating to artificial intelligence (AI) inventions: The Guidance)1)’을 발표함

- (개요) 동 가이드라인은 AI 발명의 특허 출원 심사에 도움을 주고자 UKIPO의 심사 관행을 설명한 것으로, AI 발명과 관련된 공개의 충분성(Sufficiency) 요건에 대해서도 간략히 언급하고 있으며, AI 발명과 관련된 다양한 시나리오(AI 발명의 작동 방법, 특허 청구항의 예시 등)2)를 첨부 문서로 제공함

- (주요내용) 동 가이드라인의 주요내용은 다음과 같음
∙ AI에 대해 단 하나의 합의된 정의는 없으나, 영국 정부는 AI를 “시각적 인식, 음성 인식 및 언어 번역과 같은 인간의 지능이 필요한 작업을 수행할 수 있는 기술3)”로 정의함
∙ AI 발명은 모든 기술 분야에서 출원될 수 있으며, AI 발명의 다양한 측면(‘응용 AI’ 또는 ‘코어 AI’)에 대해 특허 보호를 요청할 수 있음
∙ ‘응용 AI’ 발명은 AI 분야 이외의 분야에 AI 기술을 적용한 것이며, ‘코어 AI’ 발명은 AI 기능의 어떠한 응용 또는 사용 사례가 아닌 AI 그 자체의 발전(예: 개선된 AI 모델, 알고리즘 또는 수학적 방법)을 의미함
